Privacy Policy

1.Basic Policy

Fuji Dream Airlines Co.,Ltd.,(hereinafter called to as “FDA”) acknowledges the importance of Personal Information defined in the following article 2, believes that protection of Personal Information is our social responsibility, complies with any laws, company’s rules etc., regarding Personal Information and properly acquires, uses and manages Personal Information handled by FDA.

2. Scope of application

  1. This Privacy Policy provides the policies which FDA shall comply with when FDA receives its customers’ Personal Information or any compatible information in providing FDA’s various services.
  2. “Personal Information” in this Privacy Policy shall mean the following a and b collectively.
    a)Information defined in Article 2 (1) of Act on the Protection of Personal Information.
    b)Collection of information including the information provided in the previous paragraph a) which is compiled in a Database, etc. of Personal Information so that it is structurally organized to enable such information provided in the previous paragraph a) to be easily retrieved from it.
     
     

3.Purpose for use of Personal Information

    FDA uses its customers’ Personal Information for the following purposes.

  1. For providing air transport services
    Reservation, sales, check-in, airport services, on-board services.
  2. For sending goods, prizes etc.
  3. For sending guidance or information regarding goods, services, events, campaign etc., or conducting survey.
  4. For improving or analyzing of FDA’s goods or services.
  5. For responding to inquiries or requests from customers.

4.Obtain, management and protection of Personal Information

  1. FDA will duly obtain its customers’ Personal Information as follows, in order to accomplish the purposes described in the previous article 3.
    a)Information which customers agree to provide to FDA when they order FDA’s services such as;
     name, address, telephone number, email address, birthday, illness of mind or body relating to boarding, medical history etc., such as previous illness etc., boarding location, destination.
    b)Any information which customers agree to provide to FDA with respect to FDA’s provision of its services such as;
     
     Member ID, passcode, credit card number, expiration date of credit card, place of employment etc.
  2. FDA shall appropriately manage and protect Personal Information which FDA obtains from customers in accordance with Act on the Protection of Personal Information and other related laws (hereinafter collectively called to as “Related Laws”) and any (internal) regulations regarding protection of Personal Information.

5.Provision of Personal Information to third parties

Except for the following cases, in no event will FDA disclose or provide the customers’ Personal Information to third parties.

  1. Cases in which FDA obtains its customer’s own consent
  2. Cases in which the handling of Personal Information is based on laws and regulations
  3. Cases in which the handling of personal information is necessary for the protection of the life, body, or property of an individual and in which it is difficult to obtain the customer’s consent
  4. Cases in which the handling of personal information is necessary for improving public health or protecting properties and in which it is difficult to obtain the customer’s consent
  5. Cases in which the handling of personal information is necessary for cooperating with a state organ, a local government, or an individual or a business operator entrusted by either of the former two in executing the affairs prescribed by laws and regulations and in which obtaining the customer’s consent is likely to impede the execution of the affairs concerned
  6. Cases in which Personal Information is provided accompanied with business succession caused by a merger or other reason

6.Outsourcing operations to handle Personal Information

FDA may outsource some operations to accomplish the purpose of using Personal Information and may deposit the Personal Information with outside contractors.
In such event, FDA will conclude an agreement on the protection of Personal Information with the contractor and ensure the secure management of the Personal Information.

7.Request with respect to handling Personal Information

When a customer requests FDA to disclose, correct, add, delete, stop using or erase his/her Personal Information (hereinafter collectively called to as “Requests”), please inform such Requests to the Inquiry Contact described at the end of this Privacy Policy in writing accompanied by identification documents. FDA will respond to the Requests in accordance with the Related Laws. Please acknowledge in advance that, with such Requests, the customer may not be able to use FDA’s services used in the past or FDA may not be able to provide its services as the customer demands. Any actual cost and expense regarding such Requests and FDA’s charge for the response shall be born by the customer.

8.Change of Privacy Policy

FDA may change this Privacy Policy without any prior notice. Please check the changed Privacy Policy on the FDA’s website.

9.Special provisions regarding Personal Information of the customers in European Economic Area

FDA duly protects Personal Information of the customers in European Economic Area consisting of EU member states, Norway, Republic of Iceland and Liechtenstein (hereinafter called to as “EEA”) in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter called to as “GDPR”). The special provisions in this article 9 apply to the customers in EEA, and in the event that there is any conflict between the provisions in this article 9 and those in the previous article 1 through 7 the provisions in this article 9 shall prevail. Notwithstanding the provision of the previous article 2, the personal information in this article 9 shall be subject to the definition provided in Article 4 (1) of GDPR.

  1. Consent or permission of guardian
    Customers under the age of 16 shall obtain his/her guardian’s consent or permission for using FDA’s products or services.
  2. Data transfer to the outside of EEA
    FDA may transfer the customers’ personal information to the countries outside EEA (including but not limited to Japan) in order to accomplish the purposes (including providing air transport services) described in the previous article 3. The Customers shall be deemed to agree to the following a) and b) with their consent to this Privacy Policy.
    a) In countries outside EEA, paving the way for laws for data protection to the same extent as EEA or recognition of rights of individuals are not necessarily guaranteed.
     
    b) In order to accomplish the purpose of use, customers’ personal information may be transferred to FDA’s hubs or others located out of EEA.
     
  3. Customers’ rights
    FDA’s customers have the following rights regarding FDA’s handling of customers’ personal information and FDA will respond to its customer’s request to enjoy his/her rights to the reasonable extent; provided, however, that the customer shall agree in advance that, as a result of such enjoyment of the following b), c), e) or f), FDA may not be able to provide the services which FDA had been providing in the past or to provide the services according to the customer’s requests.
    a)Right to access
     A customer may ask FDA to explain his/her personal information held by FDA and to copy such personal information.
    b)Rights to correct or delete
     A customer may ask FDA to correct his/her inaccurate personal information held by FDA. Also a customer may ask FDA to delete his/her personal information held by FDA at any time and FDA will respond to such customer’s request unless the case falls into any of the exceptions described in paragraph 3 of Article 17 of GDPR.
    c)Rights to ask for limitation of handling or to lodge a complaint against handling
     In the event that FDA fails to handle personal information or falls into any of the events described in paragraph 1 of Article 18 of GDPR, the customer may ask FDA to restrict the handling of personal information or may lodge a complaint against the handling of personal information.
    d)Right to data portability
     A customer shall have the right to receive and transmit to another controller his/her personal information held by FDA
    e)Right to lodge a complaint with a supervisory authority
     A customer who is dissatisfied with FDA’s handling of his/her personal information shall have the right to lodge a complaint with the competent data protection authority having jurisdiction over the place in which the customer lives or works or any breach regarding such handling happens.
    f)Right to withdraw consent
     A customer may withdraw the consent regarding FDA’s handling of his/her personal information at any time and such withdrawal will become prospectively effective at the time of withdrawal.

  4. Data storage period
    FDA will store the customers’ personal information for a certain period. Such storage period is 10 years after when the purpose of use has been accomplished; provided that FDA will store the personal information for the further period in accordance with any applicable laws.
  5. Change of purpose of use
    In the event that FDA changes the purpose of using customers’ personal information, FDA will do so by adding the purpose after the change and its related information in advance.
