Domestic passenger transportation conditions

Chapter 1 General Provisions

Article 1: Definitions

In these terms and conditions, "domestic air transportation" refers to transportation by aircraft provided by the Company, whether for a fee or free of charge, in which the points of departure and arrival under the transportation contract and all other landing points are within Japan.
"Company" refers to Fuji Dream Airlines Co., Ltd.
"Company establishments" refers to the company's offices (city offices, airport offices), the offices of agents designated by the company, and the company's web pages on the Internet.
"Ticket" means an electronic document in a form recorded in the Company's electronic database (hereinafter referred to as "Electronic Ticket") issued by the Company's business establishment for the transportation of passengers on the Company's domestic air routes in accordance with these Conditions of Carriage.
"Authentication code" refers to a confirmation number that can prove that you have an electronic ticket, or any other number specified by the Company.
"Stopover" means a planned interruption in a passenger's journey between the point of departure and the destination that is approved in advance by the carrier.
"Baggage" means property owned by a passenger, including checked baggage and carry-on baggage, unless otherwise specified.
"Checked baggage" refers to baggage that the Company has received and for which it has issued a baggage identification tag.
"Carry-on baggage" refers to baggage other than checked baggage that the Company approves as being brought onto the aircraft.
"Baggage Identification Tag" means a document issued by the Company solely for the purpose of identifying checked baggage, a part of which is attached to each piece of checked baggage as a baggage attachment, and the other part is given to the passenger as a claim slip.

Article 2 Application of Terms and Conditions

  1. These conditions of carriage apply to domestic air transport of passengers and baggage and any services incidental thereto conducted by the Company.
  2. The conditions of carriage in force on the day the passenger boards the aircraft and any regulations prescribed thereunder shall apply to the carriage of the passenger.
  3. If a special agreement is made regarding any provision of these terms and conditions of carriage, the special agreement will apply regardless of the provisions of that provision.

Article 3 Changes to Terms and Conditions

When changes are made to the Company's terms and conditions of transportation and regulations established thereunder, the Company will notify the changes by posting them on its website etc. with a reasonable period of time.

Article 4 Public Notice

The Company will publish these terms and conditions of transportation, as well as passenger fares, excess baggage charges and other fees, flight timetables and other necessary information at its offices.

Article 5 Passenger consent

Passengers acknowledge and agree to these conditions of carriage and the regulations established thereunder.

Article 6 Governing Law and Jurisdiction

  1. The provisions of this contract of carriage shall be interpreted in accordance with the laws of Japan, and any matters not provided for in this contract of carriage shall be governed by the laws of Japan.
  2. Any disputes regarding transportation under these terms and conditions of transportation shall be subject to the jurisdiction of the Japanese courts, regardless of who the claimant is, or what the legal basis for the claim is, and the proceedings shall be governed by Japanese law.

Article 7 Instructions from staff

Passengers must follow all instructions from airline staff regarding boarding, disembarking, and other actions at the airport and on board the aircraft, as well as the location of loading and unloading of baggage, etc.

Chapter 2 Passenger Transportation

Section 1 Airline Tickets

Article 8 Issuance and validity of air tickets

  1. The Company will issue an Electronic Ticket at the Company's business establishments upon receipt of a fare or fee as specified separately. When issuing an Electronic Ticket, the passenger must provide his/her name, age, sex, and contact information (telephone number of work or address, etc.).
  2. Airline tickets may only be used by the passenger himself/herself and cannot be transferred to a third party.
  3. An air ticket will become invalid if it is not used in accordance with the details recorded in the electronic database (hereinafter referred to as "reservation details").
  4. In order for the Company to verify the validity of an air ticket, the presentation or declaration of an authentication code (hereinafter referred to as "presentation of an authentication code, etc.") is required.
  5. When requesting transportation, a passenger must present a valid passenger authentication code that has been duly issued in accordance with the carrier's regulations and is valid for the flight that the passenger is currently boarding. If the passenger fails to do so, the carrier may refuse to allow the passenger to board the flight.
  6. If the authentication code, etc. is used illegally (including if it is transferred and used), the company shall not be liable for any damages.

Article 9 Validity Period

Tickets are valid only for the scheduled flight.

Article 10 Extension of Validity Period

  1. If a passenger is unable to travel due to illness or other reasons, or if the company is unable to provide the reserved seat, the validity period of the ticket may be extended. However, the extension cannot be extended for more than 30 days counting from the day after the expiration date.
  2. If the validity period is extended as described above, the period of the tickets held by the passenger's companions may also be extended in the same way.

Article 11 Seat Reservation

  1. You need to reserve a seat to board the aircraft.
  2. When applying for a seat reservation, you must present an authentication code and have the necessary information recorded in the company's electronic database.
  3. When canceling or changing a seat reservation, you will be required to present an authentication code, etc. However, you cannot change the reserved passenger to another person.
  4. Notwithstanding the provisions of the previous two paragraphs, at business locations separately designated by the Company, applications for seat reservations, or requests for cancellations or changes may be accepted even if an authentication code is not presented.
  5. A seat reservation under the preceding paragraph is not guaranteed until the passenger purchases a ticket by the ticket purchase deadline set by the Company. If a passenger does not purchase a ticket by the ticket purchase deadline set by the Company, the Company may cancel the said seat reservation and any subsequent seat reservations made under that reservation at any time without prior notice.
  6. Seat reservation applications are accepted at the Company's offices from two months prior to the desired boarding date. However, this does not apply if the Company specifies otherwise for passengers paying a specific fare.
  7. If Article 19 Paragraph 1 applies, the Company may cancel any subsequent seat reservations made in relation to this reservation.

Article 12 Seat Reservation

Passengers may be able to reserve a specific seat on the aircraft in advance. However, the Company may change this without prior notice due to changes in aircraft type or other unavoidable operational reasons.

Article 13 Meeting Time

  1. When a passenger boards an aircraft, they must arrive at the location and time designated by the Company in order to complete the procedures required for boarding.
  2. The Company may refuse boarding to passengers who are late for the meeting time specified in the previous paragraph.
  3. The carrier cannot delay the departure of an aircraft due to a passenger who is late for the scheduled departure time.

Article 14 Refusal and Restriction of Carriage

If the Company determines that any of the following items apply to a passenger, it may refuse boarding to the passenger or have him/her disembark. In such cases, the Company will treat the passenger's baggage in the same manner. In such cases, it will provide a refund in accordance with the provisions of Article 19, Paragraph 1. In addition to the above measures, in cases falling under (F) or (H) of Paragraph (3) of this Article, the Company may take measures it deems necessary to prevent the continuation of the said behavior. Such measures include restraining the person in question.

  1. When necessary for flight safety
  2. When necessary to comply with laws, regulations, or requests from government agencies
  3. If the passenger's conduct, age, or mental or physical condition falls under any of the following:
    (stomach) If the company requires special handling
    (B) Seriously injured or ill people or children under 8 years old who are not accompanied by an adult
    (C) If you have an infectious disease or suspected infectious disease
    (D) When carrying the following items:
      Weapons (excluding those carried in the course of official duties), gunpowder, explosives, other corrosive articles, flammable articles, articles that cause a nuisance or danger to the aircraft, passengers or cargo on board, articles or animals unsuitable for carriage by aircraft.
    (E) When there is a risk of causing discomfort or inconvenience to other passengers
    (F) If the Passenger engages in any conduct that may be harmful to himself/herself, other people, the aircraft or property.
    (to) In cases falling under Article 26, Paragraph 4 or 5
    (blood) If you interfere with the work of company staff or do not follow their instructions
    (R) Using mobile phones, portable radios, electronic games or other electronic devices on board without the permission of the company
    (N) If you use cigarettes, e-cigarettes, heated tobacco products or other smoking devices on board

Section 2. Fares and charges

Article 15 Passenger fares and charges

  1. Passenger fares and charges, as well as the conditions for their application, are determined by the fare table separately determined by the Company for each type.
  2. Passenger fares are the fares for transportation from the airport of departure to the airport of destination.
  3. Passenger fares and charges include consumption tax (including local consumption tax).

Article 16 Applicable fares and charges

  1. Applicable fares and charges shall be those valid on the date of ticket issue and on the day the passenger boards the aircraft, unless otherwise specified by the Company's regulations.
  2. If the collected fare or fee differs from the applicable fare or fee, the difference will be refunded or collected as appropriate for each case, unless the Company specifies otherwise for passengers who pay specific fares and fees.

Article 17 Free carriage of infants

The Company will accept the transportation of one passenger under the age of three (hereinafter referred to as "infant") not occupying a seat who is accompanied by a passenger aged 12 or over free of charge, but only one infant per accompanying person.

Article 18 Changes due to passenger convenience

Any changes to the date, time, flight, segment or destination shown on the ticket due to passenger convenience will be subject to the applicable conditions separately stipulated by the Company for each type of fare and fee. Fares and fees that can be changed due to passenger convenience will be accommodated as follows only if the authentication code is presented and the request for change is made to a Company office within business hours up until the scheduled departure time of the scheduled flight. However, this does not apply if there are no seats available.

  1. If the applicable fares and charges for the entire route as a result of the change are greater than the collected fares and charges, the difference will be charged. If the applicable fares and charges are less than the collected fares and charges, the difference will be refunded.
  2. The fares and charges that apply as a result of such changes shall be the passenger fares and charges that were valid on the date of issue of the originally purchased ticket and on the date on which the passenger boards the changed aircraft, unless otherwise specified in the Company's regulations.
  3. In the case of cancellation of a reserved flight due to a change, the cancellation fee stipulated in Article 19, Paragraph 1 will not be charged.
  4. If such changes result in fees being applied or no longer being applicable, we will collect or refund the fees, as appropriate.

Article 19 Refunds and Cancellation Fees due to Passenger Convenience

  1. In the case of a refund for a passenger's convenience, the full amount of the fare and charges will be refunded if the entire travel section is refunded, and the difference obtained by deducting the fare and charges for the boarding section from the fare and charges will be refunded if a partial refund is made. In this case, the Company will charge a cancellation fee according to the fare and charge table separately stipulated by the Company for each type of fare and charge.
  2. In the case of the preceding paragraph, if the fare and charges received are less than the cancellation fee, the cancellation fee will be charged up to the fare and charges received.

Article 20 Refund Period

Passenger fares or charges will be refunded only within one month from the date of reservation cancellation or the scheduled boarding date, whichever is earlier.

Article 21 Cancellation or change due to company circumstances

  1. If the Company is unable to fulfill all or part of the transportation contract due to reasons other than the passenger's convenience, excluding reasons specified in Article 40, Paragraph 5 (hereinafter referred to as "Company convenience"), the passenger may choose to take one of the following measures:
    1. To facilitate the transport of the passenger and baggage to the first destination specified in the reservation on the ticket by any of the following means as selected by the Carrier:
      (stomach) Company aircraft with available seats
      (B) Flights with available seats on other airlines
      (C) Other transport options
        In this case, even if passenger fares and charges due to changes in flights, routes, etc. are greater than the refund amount of the applicable fares and charges for that section, they will not be charged, and if they are less, they will be refunded. However, if the Company has stipulated otherwise for a specific ticket, no refund will be made.
    2. To refund. In this case, if the trip has not yet commenced, the full amount of the fare and fees collected will be refunded. If the trip has already commenced, the applicable fare and fees from the point of cancellation to the destination shown on the ticket (including any planned stopovers) will be refunded.
    3. Extend the validity period for the unused segments
  2. In the event that the number of passengers requesting to check in for their reserved flight by the time specified by the Company exceeds the seating capacity of the reserved flight and therefore some passengers cannot be provided with seats (excluding cases resulting from reasons specified in Article 40, Paragraph 5), the Company will solicit passengers with valid seat reservations who voluntarily cancel boarding the reserved flight in response to the Company's request for cooperation. In such cases, in addition to the treatment specified in Paragraph 1 of this Article, the Company will pay a certain amount of cooperation money, etc., as specified by the Company, to passengers who cancel boarding in response to the request.

Article 22 Cancellation or change due to reasons other than those of the Company or the passenger

If the Company is unable to fulfill all or part of the transportation contract due to reasons stipulated in Article 40, Paragraph 5, the passenger may choose to take one of the following measures:

  1. Before the start of the trip, the passenger and baggage will be transported to the destination indicated on the ticket on a Company aircraft with available seats. If the destination indicated on the ticket is changed after the start of the trip, the Company will facilitate the transport of the passenger and baggage to the first destination indicated on the ticket by one of the following means selected by the Company:
    (stomach) Company aircraft with available seats
    (B) Flights with available seats on other airlines
    (C) Other transport options
      In this case, even if the passenger fare and charges due to the change in flight, route, etc. are greater than the refund amount of the applicable fare and charges for that section, they will not be charged, and if they are less, they will be refunded.
  2. To refund. In this case, if the trip has not yet commenced, the full amount of the fare and fees collected will be refunded. If the trip has already commenced, the applicable fare and fees from the point of cancellation to the destination shown on the ticket (including any planned stopovers) will be refunded.
  3. Extend the validity period for the unused segments

Article 23 Unauthorized boarding

In the following cases, it will be considered as illegal boarding, and the passenger will be charged the fare and charges for the illegally boarded section, plus twice the highest fare and charges set for that section at the time of boarding. However, if the boarding section cannot be determined, it will be considered as from the departure point of the aircraft.

  1. When the passenger fails to present the authentication code despite being requested to do so by an airline staff member, or travels beyond the section indicated on the ticket without the consent of an airline staff member.
  2. When a passenger intentionally boards a flight using an invalid ticket
  3. When a passenger receives special fare treatment due to a false declaration

Section 3: Baggage

Article 24 Checked and carried baggage

  1. When a passenger presents a valid authentication code and submits his/her baggage at the airport office of the Company by the time specified by the Company, the baggage will be accepted as checked baggage or carry-on baggage in accordance with the provisions of these Conditions of Carriage.
  2. In addition to the preceding paragraph, when requested by a passenger who is transferring to a connecting flight operated by another carrier at the arrival airport on the Company's route (limited to those with which the Company has an agreement regarding baggage transportation with that other carrier), if the passenger presents, at the Company's airport office by the time specified by the Company, a valid authentication code issued for transportation on the Company's route, as well as a valid authentication code or ticket issued for transportation of the connecting flight operated by that other carrier, and submits his/her baggage, the Company will also check the baggage for transportation on the connecting flight operated by that other carrier.
    In this case, the Company will, with the passenger's consent, act as agent for the other carrier and accept the baggage in accordance with the terms and conditions of the other carrier, and will not deliver the checked baggage to the passenger at the destination airport on the Company's route.
  3. The Company will issue a baggage identification tag for checked baggage.

Article 25 Loading of Checked Baggage

Checked baggage will be transported on the aircraft the passenger is boarding. However, in cases of load capacity or other unavoidable circumstances, the baggage may be transported on an aircraft capable of carrying the baggage.

Article 26 Security Inspection

  1. Passengers must undergo security inspection by the Company. However, this does not apply if the Company deems it unnecessary.
  2. For aviation security reasons (including the prevention of illegal seizure, control, or destruction of aircraft) or other reasons, the Company may request the presence of the passenger or a third party and inspect baggage by opening and inspecting it or by other means. In addition, even if the passenger or a third party is not present, the Company may inspect whether the passenger is carrying or the passenger's baggage contains any items that fall under the prohibited or restricted items for baggage stipulated in Article 30.
  3. For aviation security reasons (including the prevention of illegal acts of seizure, control, or destruction of aircraft) or for other reasons, the Company may inspect passengers' clothing or equipment by touching them or by using metal detectors or other devices to inspect any items worn by passengers.
  4. If a passenger does not comply with the inspection in paragraph 2 above, the Company will refuse to load the baggage.
  5. If a passenger does not comply with the inspection prescribed in paragraph 3 above, the Company will refuse boarding to that passenger.
  6. If, as a result of the inspection under Paragraphs 2 or 3 above, the Company discovers any article that falls under the prohibited or restricted items for baggage stipulated in Article 30, it may refuse to allow such article to be carried or loaded on board, or may dispose of such article.

Article 27 Delivery of Checked Baggage

  1. When the baggage becomes available for collection at the destination, the passenger must collect the baggage by checking the numbers on the baggage claim tag (the baggage claim tag and the piece of paper attached to the baggage).
  2. The Company will only deliver baggage to the bearer of the baggage claim tag (baggage claim tag and baggage attachment) issued when the baggage was checked in. At that time, the passenger must present the baggage claim tag to the Company.
  3. When baggage is delivered in accordance with the provisions of the preceding two paragraphs, the Company is under no obligation to verify whether the bearer of the baggage identification tag is the rightful recipient of the baggage. The Company shall not be liable for compensation for damages incurred as a result of the Company's failure to verify whether or not the bearer is the rightful recipient of the baggage.
  4. Baggage will be delivered only to the destination shown on the baggage tag, unless specifically requested by the person checking the baggage, in which case delivery may be made at the place of departure or at an intermediate stopover, if circumstances permit.

Article 28 Loss of baggage claim tag

When a baggage claim tag is lost, the Company will only deliver the baggage in accordance with procedures stipulated separately if the Company recognizes the person requesting delivery of the checked baggage as the rightful recipient and receives a guarantee from the person requesting delivery that the Company will compensate for all losses that the Company may suffer as a result of delivering the baggage to that person.

Article 29 Disposal of Undeliverable Baggage

If baggage is not collected within seven days of arrival, the Company may dispose of the baggage as appropriate. In this case, all damages and expenses shall be borne by the passenger.

Article 30 Prohibited and restricted items in baggage

  1. The following items will not be accepted as checked baggage. However, this does not apply if the Company gives its consent.
  2. (1) Anything that may be dangerous or a nuisance to the aircraft, personnel or equipment on board
    (2) Firearms, swords, explosives and other flammable or combustible items
    (3) Corrosive chemicals and liquids not in proper containers
    (4) animal
    (5) Corpse
    (6) Items that are prohibited from being loaded or moved on an aircraft due to laws, regulations, or requests from government agencies.
    (7) Any item that exceeds the limits separately set by the Company with regard to volume, weight or number of items
    (8) Items that are incompletely packed or wrapped
    (9) Items that are easily altered, worn out or damaged
    (10) Any other items that the Company considers unsuitable for transportation as baggage
  3. The following items are not permitted as carry-on baggage:
  4. (1) Cutlery
    (2) Guns, swords, and other similar items, as well as explosives (pistol-shaped lighters, grenade-shaped lighters, etc.)
    (3) Any other items that the company considers to be weapons (bats, golf clubs, ice skates, etc.)

Article 31 Expensive Items

Platinum, gold, other precious metals, coins, banknotes, securities, stamps, jewelry, works of art, antiques, and other valuable items are not accepted as checked baggage.

Article 32 Free Baggage Allowance

  1. Checked baggage is free up to 20 kilograms. The following items are accepted free of charge regardless of the limit:
    1. Wheelchairs used by disabled passengers
    2. Foldable strollers, portable cradles and child seats used by passengers traveling with infants or small children
  2. Carry-on baggage is free of charge for items specified in Article 34, Paragraphs 1, 2 and 4.
  3. For infants not occupying a seat, the free baggage allowance stipulated in the previous two paragraphs does not apply.

Article 33 Checked Baggage

Checked baggage is limited to 100 kilograms per passenger, and unless otherwise specified by the Company, the weight of each piece is limited to 32 kilograms, and the volume is limited to within 50cm x 60cm x 120cm. If it exceeds these restrictions, it cannot be checked in as baggage.

Article 34 Carry-on baggage

  1. Baggage that may be brought on board is limited to one piece that can be stored in the overhead compartment or under the seat in front of the passenger and the sum of the three dimensions is 100cm or less. However, baggage that the Company determines cannot be safely stored in the cabin cannot be brought on board.
  2. In addition to the above, one shopping bag or other baggage for storing personal items will be permitted as carry-on baggage.
  3. The total weight of carry-on baggage as specified in the preceding two paragraphs must not exceed 10 kilograms.
  4. Notwithstanding the provisions of the preceding three paragraphs, the following items may be carried on board the aircraft:
  5. (1) Child seats that are attached to the seat during the flight (limited to those designated by the company)
    (2) Crutches, walking sticks, splints and other prosthetic limbs used by physically disabled passengers
    (3) Guide dogs, service dogs and hearing dogs accompanying disabled passengers
    (4) Bags containing infant or child items needed during the flight
    (5) A portable cradle for use by a passenger for an infant or small passenger accompanied by the passenger
    (6) Other items that the carrier specifically approves as carry-on items
  6. The Company will not accept as carry-on baggage any items other than those specified in paragraphs 1, 2, and 4.

Article 35 Pet animals

  1. The Company will accept the carriage of pets accompanying passengers as checked baggage. Pets here refer to tame small dogs, cats, birds, etc. However, French bulldogs and bulldogs will not be accepted for carriage as checked baggage.
  2. Pets as mentioned in the previous paragraph are not subject to the free baggage allowance stated in Article 32, and passengers must pay a fee per cage as specified by the Carrier.

Article 36 Excess Baggage Charges

  1. Any checked baggage in excess of the free baggage allowance stipulated in Article 32 will be charged at excess baggage charges.
  2. Excess baggage charges are determined separately.

Article 37 Refund of Pet Fees and Excess Baggage Charges

  1. If the transportation of the pet is canceled up to 20 minutes prior to the flight departure time, the full amount of the pet fee and excess baggage fee collected for the canceled transportation route will be refunded.
  2. If the time specified in the preceding paragraph has passed, or if transportation is cancelled midway due to passenger convenience, the fees for pets and excess baggage charges for the onward section not loaded will not be refunded. However, this does not apply if the transportation contract cannot be fulfilled in whole or in part due to the Company's convenience.

Article 38 Valuable charges

If the total value of carry-on baggage and any items worn by the passenger exceeds 150,000 yen, the passenger may declare that value. In this case, the carrier will charge an ad valorem fee of 10 yen for every 10,000 yen of the declared value that exceeds 150,000 yen.
However, the declared value per passenger is limited to 300,000 yen.

Article 39 Refund of ad valorem fees

  1. If a passenger does not board a flight for personal reasons and cancels the entire trip, the full ad valorem fare for the cancelled transportation section will be refunded.
  2. In the event that a passenger cancels part of a trip due to personal reasons, the ad valorem fare will not be refunded. However, this does not apply if the carrier is unable to fulfill all or part of the transportation contract due to its own reasons.

Section 4 Responsibility

Article 40 Company Liability

  1. The Company will be liable for compensation for damages incurred in the event of the death or injury of a passenger or other bodily injury if the accident or incident that caused the damage occurred on board the aircraft or during boarding and disembarking procedures.
  2. The Company will be liable for compensation for damages incurred in the event of the destruction, loss, or destruction of checked baggage or other property of the passenger entrusted to the Company for custody, if the accident or incident that caused the damage occurred while the baggage or property was under the Company's control.
  3. The Company shall not be liable for compensation for damages under Paragraphs 1 and 2 of this Article if it proves that the Company and its employees (in this Chapter, "employees" refers to employees, agents, contractors, and other assistants in the performance of the contract) took the necessary measures to prevent such damages or failed to take such measures.
  4. The Company will only be liable for compensation for damages incurred in the event of breakage, destruction, loss or damage to carry-on baggage or other items carried or worn by the Passenger if it is proven that the Company or its employees were negligent.
  5. The Company may, without prior notice, change aircraft flight schedules, cancel or suspend flights, suspend operations, change departure and arrival airports, make emergency landings, restrict passenger boarding, remove all or part of baggage, or take other necessary measures due to legal requirements and government agency requirements, requirements for aviation security (including the prevention of acts of unlawful seizure, control or destruction of aircraft), bad weather, force majeure, industrial action, riots, disturbances, war, or other unavoidable circumstances caused by the Company, but the Company shall not be liable to compensate for damages incurred as a result of taking such measures, except in cases where the Company is liable pursuant to Paragraphs 1, 2, 3 and 4 of this Article.

Article 41 Exemption from liability for defects inherent in baggage

The Company shall not be liable for compensation for damages incurred in the event of destruction, loss, or damage to checked baggage or other passenger property entrusted to the Company for custody if such damages arise solely from an inherent defect, quality or flaw in the baggage or property.

Article 42 Contributory Negligence

If the Company proves that the passenger's willful misconduct or negligence caused or was related to the cause of the damage, the Company will be exempt from all or part of its liability to the passenger to the extent that the passenger's willful misconduct or negligence caused or was related to the cause of the damage.

Article 43 Passenger Liability

If the Company incurs damages due to the passenger's willful or negligent acts, or due to the passenger's failure to comply with these Conditions of Carriage and the regulations established thereunder, the passenger must compensate the Company for the damages.

Article 44 Company Liability Limit

  1. The Company's liability for the transportation of baggage is limited to a total amount of 150,000 yen per passenger. However, if a passenger declares a higher value for the baggage before the start of transportation and pays the ad valorem charge in accordance with the provisions of Article 38, the Company's liability shall be limited to the declared value, but even in this case, the Company's liability shall not exceed the actual value of the baggage.
  2. In the preceding paragraph, "baggage" includes checked baggage and other items of a passenger entrusted for storage by the Company, as well as carry-on baggage and other items carried or worn by a passenger.

Article 45 Period for claiming compensation for baggage

  1. When a passenger accepts checked baggage or other items entrusted to the carrier for custody without raising any objection, the baggage or items are presumed to have been delivered in good condition.
  2. Notification of damage to checked baggage or other property of a passenger entrusted to the custody of the carrier must be given in writing within three days of receipt for baggage or property received, or within 14 days of the date on which it should have been received if not delivered.
  3. If the notice is not given within the period set forth in paragraph 2 of this Article, the Company shall not be liable for compensation.

Article 46 Non-application of liability limits

The liability limit set out in Article 44 shall not apply if it is proven that the damage was caused by the willful act or gross negligence of the company or its employees. However, in the case of willful act or gross negligence of an employee, it must also be proven that he/she was in the course of performing his/her duties.

Article 47 Successive transport

  1. When the Company checks baggage for transportation by another carrier, the Company does so only as agent for that carrier.
  2. In the event of damage caused by the successive carriage of baggage by two or more carriers, compensation may only be claimed against the carrier whose carriage caused the damage.
    The Company shall not be liable for any damage to baggage caused by any cause other than transportation performed by the Company.

Article 48 Change of Carrier

If, with the consent of the Company, a carrier is changed and a passenger boards a route of another carrier using the Company's ticket, the transportation will be subject to the conditions of carriage of the other carrier and the Company will not be liable for any such transportation.

Article 49 Application of the Terms and Conditions to Employee Conduct

If an employee of the Company proves that he/she was performing his/her duties, he/she may invoke all provisions related to the exclusion or limitation of the Company's liability set out in these Conditions of Carriage and regulations based thereon with respect to damages set out in these Conditions of Carriage.

These terms and conditions of transportation will be applied from June 1, 2024.
