Chapter 1 General Provisions
Article 1 Definitions
In these Terms and Conditions of Carriage, "domestic air transport" means air transport carried out by the Company by aircraft, whether for a fee or free of charge, where the departure point, destination, and all other landing points specified in the transport contract are located within Japan.
"The company" refers to Fuji Dream Airlines Co., Ltd.
"Company offices" refers to the company's offices (city offices, airport offices), the offices of the company's designated agents, and the company's web pages on the internet.
"Airline ticket" refers to an electronic document (hereinafter referred to as "electronic airline ticket") issued at the company's offices for the purpose of transporting passengers on the company's domestic air routes in accordance with these terms and conditions of carriage, and recorded in the company's electronic database.
"Authentication code" refers to a confirmation number that can prove you possess an electronic ticket, or any other code specified separately by the company.
A "stopover" refers to a planned interruption of a passenger's journey at a point between their departure point and destination, which has been approved in advance by the airline.
"Baggage" refers to items carried by passengers, unless otherwise specified, and includes both checked baggage and carry-on baggage.
"Checked baggage" refers to baggage that has been received by the company and for which a baggage claim tag (exchange receipt) has been issued.
"Carry-on baggage" refers to any baggage other than checked baggage that the airline allows passengers to bring onto the aircraft.
A "baggage tag" is a tag issued by the airline solely for the purpose of identifying checked baggage. Part of it is attached to individual items of checked baggage as a baggage attachment, while the other part is given to the passenger as a claim ticket.
Article 2 Application of Terms and Conditions
These terms and conditions of carriage apply to the domestic air transport of passengers and baggage and related services provided by the Company.
The conditions of carriage and the regulations established thereunder, which are in effect on the day the passenger boards the aircraft, shall apply to the carriage of that passenger.
If any special agreement is made regarding certain provisions of these terms and conditions of carriage, those special agreements shall apply regardless of the provisions of those provisions.
Article 3 Changes to Terms and Conditions
When the company's terms and conditions of carriage and the regulations established thereunder are changed, the changes will be announced by posting them on the website or other means with a reasonable period of time.
Article 4 Public notice
The company's offices will post these terms and conditions of carriage, along with passenger fares, excess baggage charges, other fees, flight schedules, and other necessary information.
Article 5 Passenger consent
Passengers acknowledge and agree to these terms and conditions of carriage and the regulations established thereunder.
Article 6 Governing Law and Jurisdiction
The provisions of these terms and conditions of carriage shall be interpreted in accordance with Japanese law, and matters not stipulated herein shall be governed by Japanese law.
-
Any disputes relating to transportation under these terms and conditions of carriage shall be subject to the exclusive jurisdiction of Japanese courts, regardless of who the claimant is or the legal basis of the claim for damages, and such proceedings shall be governed by Japanese law.
Article 7 Instructions from staff
Passengers must follow the instructions of airline staff regarding boarding, disembarking, other actions at the airport and on board the aircraft, and the location for loading, unloading, or storing baggage.
Chapter 2 Passenger Transportation
Section 1 Air Tickets
Article 8 Issuance and validity of airline tickets
-
The company will issue electronic airline tickets at its offices for a separately determined fare or fee. When issuing the tickets, passengers must provide their name, age, gender, and contact information (such as their workplace or home phone number).
Airline tickets are for the exclusive use of the passenger and cannot be transferred to a third party.
Airline tickets become invalid if they are not used in accordance with the information recorded in the electronic database (hereinafter referred to as "reservation details").
In order for the company to verify the validity of the airline ticket, the presentation or declaration of an authentication code (hereinafter referred to as "presentation of authentication code, etc.") is required.
-
When seeking transportation, passengers must present their own authentication code, which is properly issued in accordance with company regulations and is valid for the flight they intend to board. Failure to do so may result in the company refusing boarding to the passenger.
The company shall not be liable for any damages incurred if authentication codes or other credentials are used fraudulently (including when they are obtained from another party and used).
Article 9 Validity Period
The ticket is valid only for the scheduled flight.
Article 10 Extension of Validity Period
-
If a passenger is unable to travel due to illness or other reasons, or if the airline is unable to provide the reserved seat, the validity period of the ticket may be extended. However, the extension cannot exceed 30 days from the day following the expiration date.
-
If the validity period is extended pursuant to the preceding paragraph, the same extension may also be applied to the tickets held by the passenger's companions.
Article 11 Seat Reservations
-
To board an aircraft, you need to reserve a seat.
-
When making a seat reservation, you must present an authentication code and have the required information recorded in the company's electronic database.
-
When requesting to cancel or change a seat reservation, you will need to present an authentication code, etc. However, you cannot change the passenger who has already made a reservation to another person.
-
Notwithstanding the provisions of the preceding two paragraphs, at business locations designated separately by the Company, applications for seat reservations, or requests for cancellation or changes, may be accepted even without presentation of an authentication code.
-
The seat reservation made under the preceding paragraph is not guaranteed until the passenger purchases the ticket by the deadline set by the company. If the passenger does not purchase the ticket by the deadline set by the company, the company may cancel the seat reservation and any subsequent seat reservations at any time without prior notice.
-
Seat reservations can be made at the company's offices starting two months prior to the desired departure date. However, this does not apply if the company has made separate arrangements for passengers paying specific fares.
-
The company may cancel any subsequent seat reservations if Article 19, Paragraph 1 applies.
Article 12 Seat Reservation
Passengers may be able to reserve a specific seat on board in advance. However, the airline may change this without prior notice due to changes in aircraft type or other unavoidable operational reasons.
Article 13 Meeting time
-
When passengers board an aircraft, they must arrive at the designated location by the time specified by the airline in order to complete the necessary boarding procedures.
-
The company may refuse boarding to passengers who are late for the meeting time specified in the previous paragraph.
-
The company cannot delay the departure of an aircraft for passengers who are late for the meeting time.
Article 14 Refusal and Restriction of Carriage
The company may refuse boarding or disembark a passenger if it determines that any of the following conditions apply. In such cases, the same treatment will be given to the passenger's baggage. In this case, a refund will be issued in accordance with the provisions of Article 19, Paragraph 1. In addition, in the cases of item (3) (f) or (h) of this paragraph, the company may take measures that it deems necessary to prevent the continuation of the conduct in addition to the measures described above. Such measures include restraining the person who committed the act.
-
When necessary for flight safety
-
When necessary to comply with laws, regulations, or requests from government agencies
-
If the passenger's conduct, age, or mental or physical condition falls under any of the following:
(a) When special handling by the company is required.
(b) In the case of a seriously injured or ill person or a child under 8 years of age without an accompanying person
(c) If you have an infectious disease or are suspected of having an infectious disease.
-
(d) When carrying the following items:
Weapons (excluding those carried in the course of official duties), gunpowder, explosives, articles that cause corrosion to others, flammable articles, articles that cause nuisance or danger to aircraft, passengers or cargo, articles unsuitable for transport by air, or animals. (e) When there is a risk of causing discomfort or inconvenience to other passengers.
(f) When the passenger engages in any act that may cause harm to himself/herself, other people, the aircraft, or property.
(g) In cases falling under Article 26, Paragraph 4 or 5
(H) If you interfere with the work of company staff or do not follow their instructions.
(i) Using electronic devices such as mobile phones, portable radios, electronic games, etc. on board without the permission of the Company.
(J) If you use cigarettes, electronic cigarettes, heated tobacco products, or other smoking devices on board the aircraft
Section 2 Fares and Charges
Article 15 Passenger fares and charges
-
Passenger fares and charges, as well as the conditions for their application, are determined separately by the company according to the fare and charge schedule for each type of fare.
-
Passenger fares cover transportation from the departure airport to the destination airport.
-
Passenger fares and charges include consumption tax (including local consumption tax).
Article 16 Applicable fares and charges
-
Unless otherwise specified in the company rules, applicable fares and charges will be those valid on the day the passenger boards the aircraft, as of the date the ticket is issued.
-
If the fare or charge collected differs from the applicable fare or charge, the difference will be refunded or collected as appropriate. However, this does not apply if the company has made separate arrangements for passengers paying specific fares and charges.
Article 17 Free carriage of infants
The company will transport passengers under the age of 3 who are accompanied by a passenger aged 12 or older and do not occupy a seat (hereinafter referred to as "infants") free of charge, limited to one infant per accompanying passenger.
Article 18 Changes due to passenger convenience
Changes to the date, time, flight, route, or destination stated on the ticket due to the passenger's circumstances will be subject to the applicable conditions separately determined by the company for each type of fare and charge. For fares and charges that are eligible for changes due to the passenger's circumstances, the following measures will be taken only if the request for change is made to the company's office during business hours up to the scheduled departure time of the scheduled flight, including presentation of the authentication code. However, this does not apply if there are no seats available.
-
If the applicable fare and charges for the entire route due to the change are greater than the fare and charges collected, the difference will be charged; if they are less than the fare and charges collected, the difference will be refunded.
-
Unless otherwise specified in the company rules, the fares and charges applicable as a result of this change will be those passenger fares and charges that were valid on the date the passenger boards the modified aircraft, as of the date the original ticket was issued.
-
No cancellation fee will be charged for cancellations of booked flights made for the purpose of making changes, as stipulated in Article 19, Paragraph 1.
-
If the changes result in the application of fees or the cessation of fees, we will collect or refund the fees accordingly.
Article 19 Refunds and Cancellation Fees for Passenger Convenience
-
If an airline ticket is refunded due to the passenger's circumstances, the full amount of the fare and charges will be refunded if the entire travel segment is refunded, and the difference between the fare and charges for the segment traveled and the refunded fare and charges will be refunded if only a portion of the travel segment is refunded. In this case, a cancellation fee will be charged according to the fare and charge schedule separately determined by the company for each type of fare and charge.
-
In the case of the preceding paragraph, if the fare and charges received are less than the cancellation fee, the fee will be limited to the amount of the fare and charges received.
Article 20 Refund Period
Refunds for passenger fares or charges will only be issued within one month from the earlier of the cancellation date or the scheduled departure date.
Article 21 Cancellation or Change Due to Company Convenience
-
If the Company is unable to perform all or part of the transportation contract due to reasons other than those attributable to the passenger, excluding those specified in Article 40, Paragraph 5 (hereinafter referred to as "Company's reasons"), the Company will take one of the following measures at the passenger's option:
-
The company shall arrange for the transportation of passengers and their baggage to the initial destination specified in the ticket reservation by one of the following means as selected by the company:
(B) A company aircraft with available seats
(b) Flights with available seats on other airlines
-
(c) Other means of transportation
In this case, even if the passenger fare and charges resulting from changes to the flight, route, etc., are greater than the refund amount for the applicable fare and charges for that section, no additional charges will be collected, and if they are less, the difference will be refunded. However, if the company has made separate provisions for a specific ticket, no refund will be given.
-
A refund will be issued. In this case, if the cancellation occurs before the start of the trip, the full amount of the fare and charges received will be refunded. If the cancellation occurs after the start of the trip, the applicable fare and charges from the point of cancellation to the destination indicated on the ticket (including any planned stopovers) will be refunded.
-
The validity period for the unboarded portion of the ticket will be extended.
-
-
If the number of passengers requesting to board a reserved flight by the time specified by the company exceeds the number of seats available on the reserved flight, and it becomes impossible to provide seats to some passengers (except in cases caused by reasons specified in Article 40, Paragraph 5), the company will solicit passengers with valid seat reservations who will voluntarily cancel their boarding of the flight in response to the company's request for cooperation. In this case, in addition to the treatment under Paragraph 1 of this Article, the company will pay passengers who cancel their boarding in response to the request a certain amount of compensation determined by the company.
Article 22 Cancellation or change due to reasons other than those of the Company or the passenger
If the Company is unable to perform all or part of the transportation contract due to the reasons stipulated in Article 40, Paragraph 5, the Company will take one of the following measures at the passenger's option:
-
Before the start of the trip, the company will transport passengers and their baggage to the destination indicated on the ticket using a flight with available seats on the company's aircraft. Furthermore, if the destination indicated on the ticket is changed after the start of the trip, the company will arrange for the transportation of passengers and their baggage to the original destination indicated on the ticket using one of the following methods selected by the company.
(B) A company aircraft with available seats
(b) Flights with available seats on other airlines
-
(c) Other means of transportation
In this case, even if the passenger fare and charges resulting from changes in flight, route, etc. are greater than the refund amount for the applicable fare and charges for that section, no additional charges will be collected, and if they are less, the difference will be refunded.
-
A refund will be issued.
The validity period for the unboarded portion of the ticket will be extended.
Article 23 Unauthorized boarding
In the following cases, it will be considered fraudulent boarding, and the passenger will be charged the fare and charges for the fraudulent boarding segment, plus twice the highest fare and charges set for that segment at the time of boarding. However, if the boarding segment cannot be determined, it will be considered from the departure point of the aircraft.
-
If the passenger fails to present the authentication code or take other necessary actions despite being requested by a company employee, or if the passenger travels beyond the designated route on the ticket without the consent of a company employee.
-
When you intentionally board a flight using an invalid ticket.
-
When boarding a flight after receiving special fare treatment due to a fraudulent declaration.
Section 3 Baggage
Article 24 Check-in and carry-on of baggage
-
When a passenger presents a valid authentication code and submits their baggage at the company's airport office by the time specified by the company, the baggage will be accepted as checked baggage or accepted as carry-on baggage in accordance with the provisions of these terms and conditions of carriage.
-
In addition to the preceding paragraph, if a passenger requests to transfer to a connecting flight operated by another carrier at the arrival airport of the Company's route (limited to those for which the Company has concluded an agreement with the other carrier regarding baggage transport), the Company will also accept the baggage for the connecting flight operated by the other carrier if the passenger presents a valid authentication code issued for the Company's route, along with a valid authentication code or ticket issued for the connecting flight operated by the other carrier, at the Company's airport office by the time specified by the Company, and submits their baggage.
In this case, with the passenger's consent, the company will accept the baggage as an agent of the other carrier in accordance with the terms and conditions of carriage of that other carrier, and will not hand over the checked baggage to the passenger at the destination airport of the company's route. The Company will issue a baggage identification tag for checked baggage.
Article 25 Loading of checked baggage
Checked baggage will be transported on the aircraft the passenger is traveling on. However, in cases of limited capacity or other unavoidable circumstances, the baggage may be transported on an aircraft that can accommodate it.
Article 26 Security Inspection
-
Passengers must undergo security screening by the airline. However, this does not apply if the airline deems it unnecessary.
-
The company may, for aviation security reasons (including the prevention of acts of illegal seizure, control, or destruction of aircraft) or other reasons, inspect baggage by opening and inspecting it, or by other means, in the presence of the passenger or a third party. In addition, even without the presence of the passenger or a third party, the company may inspect whether the passenger is in possession of or has in their baggage any items that fall under the prohibited and restricted items for baggage specified in Article 30.
-
For aviation security reasons (including the prevention of illegal seizure, control, or destruction of aircraft) and other reasons, the company will inspect items worn by passengers by touching them through their clothing or equipment, or by using metal detectors, etc.
-
The company will refuse to load baggage if a passenger does not comply with the inspection described in paragraph 2 above.
-
The company will refuse boarding to any passenger who does not comply with the inspection described in paragraph 3 above.
-
If, as a result of the inspection under paragraph 2 or 3 above, the company discovers any items that fall under the prohibited or restricted items for baggage specified in Article 30, it may refuse to allow such items to be brought on board or loaded onto a passenger's vehicle, or may dispose of such items.
Article 27 Delivery of checked baggage
-
Upon arrival at their destination, passengers must collect their baggage as soon as it is ready for collection, by verifying the number on their baggage claim tag (baggage claim form and baggage attachment).
-
The airline will only hand over the baggage to the person holding the baggage claim tag (baggage claim receipt and baggage attachment) issued at the time of baggage check-in. At that time, the passenger will present the baggage claim receipt to the airline.
-
When delivering baggage in accordance with the provisions of the preceding two paragraphs, the company is not obligated to verify whether the person bearing the baggage tag is the legitimate recipient of the baggage. The company shall not be liable for any damages arising from its failure to verify whether the person is the legitimate recipient.
-
Baggage will only be delivered at the destination indicated on the baggage tag. However, if there is a special request from the baggage consignor, and circumstances permit, it will be delivered at the point of departure or intermediate port of call.
Article 28 Loss of baggage claim tag
If a baggage claim tag is lost, the baggage will be returned according to a separate procedure only if the company recognizes the person requesting delivery of the baggage as the legitimate recipient and obtains a guarantee from that person that the company will compensate for any losses that the company may incur as a result of delivering the baggage to that person.
Article 29 Disposal of Undeliverable Baggage
If baggage is not claimed within 7 days of arrival, the company may dispose of the baggage as appropriate. In this case, all damages and costs will be borne by the passenger.
Article 30 Prohibited and restricted items in baggage
-
The following items are not permitted as carry-on baggage. However, this does not apply if the company has given its approval.
Anything that may be dangerous or a nuisance to the aircraft, personnel or equipment on board

Corrosive chemicals and liquids not in proper containers

Article 34 Carry-on Baggage
-
Passengers are permitted to bring one piece of carry-on baggage into the cabin. This baggage must be able to be stored in the overhead compartment or under the seat in front of the passenger, and the sum of the three dimensions must not exceed 100 cm. However, baggage that the airline deems unsafe to store in the cabin will not be allowed on board.
-
In addition to the above, you are permitted to carry one shopping bag or other type of bag containing personal belongings onto the aircraft.
-
The total weight of carry-on baggage as specified in the preceding two paragraphs cannot exceed 10 kilograms.

-
Excess baggage fees will be determined separately.

If the transportation of the pet is canceled at least 20 minutes before the scheduled departure time of the aircraft, the full amount of the fees charged for the pet and any excess baggage fees for the canceled portion of the journey will be refunded.
-
If the time specified in the preceding paragraph has elapsed, or if the passenger cancels the transport midway due to their own reasons, the fees applicable to the pet and excess baggage for the remaining unloaded portion of the journey will not be refunded. However, this shall not apply if the company is unable to fulfill all or part of the transport contract due to its own reasons.
Article 38 Ad valorem Charges
If the total value of carry-on baggage and items worn by the passenger exceeds 150,000 yen, the passenger may declare that value. In this case, the company will charge an ad valorem fee of 10 yen for every 10,000 yen exceeding the declared value of 150,000 yen. However, the declared value per passenger is limited to 300,000 yen.
Article 39 Refund of ad valorem fees
-
If a passenger cancels their entire journey due to their own reasons, they will be fully refunded the ad valorem fare for the cancelled portion of the journey.
-
If a passenger cancels part of their travel segment due to their own circumstances, the ad valorem fare will not be refunded. However, this does not apply if the company is unable to fulfill all or part of the transportation contract due to its own circumstances.

-
The company shall be liable for damages arising from the destruction, loss, misplacement, or damage of checked baggage or other passenger property entrusted to the company for safekeeping, provided that the accident or incident causing the damage occurred during the period when the baggage or property was under the company's control.
-
The Company shall not be liable for damages under paragraphs 1 and 2 of this Article if the Company and its employees (in this Chapter, "employees" means employees, agents, contractors, and other persons assisting in performance) prove that they took or were unable to take the necessary measures to prevent such damages.
-
The company will only be liable for damages arising from the breakage, loss, misplacement, or destruction of carry-on baggage or other items carried or worn by passengers if it can be proven that the company or its employees were negligent.

However, the Company shall not be liable for any damages resulting from such measures, except as otherwise provided for in paragraphs 1, 2, 3, and 4 of this Article.
Article 41 Exemption from liability for defects inherent in baggage
The company shall not be liable for damages arising from the destruction, loss, misplacement, or damage of checked baggage or other passenger property entrusted to the company for safekeeping, if such damages are solely due to inherent defects, quality issues, or flaws in the baggage or property.
Article 42 Contributory Negligence
If the company proves that a passenger's willful misconduct or negligence caused or was related to the cause of the damage, the company will be released from all or part of its liability to that passenger to the extent that such willful misconduct or negligence caused or was related to the cause of the damage.
Article 43 Passenger Liability
If the company suffers damage due to the passenger's willful misconduct or negligence, or due to the passenger's failure to comply with these terms and conditions of carriage and the provisions set forth thereunder, the passenger shall compensate the company for such damage.
Article 44 Company Liability Limit
-
The company's liability for baggage transport is limited to a total of 150,000 yen per passenger. However, if a passenger declares a value higher than that for the baggage before the commencement of transport and pays an ad valorem fee in accordance with Article 38, the company's liability shall be limited to the declared value, but even in this case, the company's liability shall not exceed the actual value of the baggage.
-
In the preceding paragraph, "baggage" includes checked baggage and other items belonging to passengers that the company has entrusted to it for safekeeping, as well as carry-on baggage and other items that passengers carry or wear.

Article 47 Successive transport
-
When the company accepts baggage for transportation by another carrier, the company acts solely as an agent for that carrier.
-
In the event of damage to baggage during successive transport by two or more carriers, compensation can only be claimed from the carrier that caused the damage. The company is not responsible for any damage to baggage that occurs outside of transport conducted by the company.
Article 48 Change of Carrier
If the carrier is changed with the company's consent and the passenger boards another carrier's route using the company's ticket, the transportation will be governed by the other carrier's terms and conditions of carriage, and the company will not be liable for any such transportation.
Article 49 Application of the Terms and Conditions to the Conduct of Employees
If an employee of the Company proves that he/she was performing his/her duties, that employee may invoke all provisions of these Terms and Conditions of Carriage and the provisions thereunder concerning the exclusion or limitation of the Company's liability with respect to damages set forth in these Terms and Conditions of Carriage.
